The deadline for filing ITR for AY 2026-27 (FY 2025-26) differs as per the taxpayer’s category. 31st July 2026 was the deadline for individuals and other taxpayers who are not required to get their accounts audited. This due date has now lapsed. But eligible taxpayers can still submit a belated return up to 31st December 2026, as per the applicable late filing fee, interest and other provisions. 

For taxpayers with business or professional income who are not required to have their accounts audited and fall under the applicable category, the deadline for filing the Income Tax Return (ITR) is August 31, 2026. Therefore, these taxpayers still have time to file their return by the original due date.

If a taxpayer has received a notice regarding non-filing of the ITR, they should file their return according to the instructions provided in the notice. Additionally, taxpayers can respond to the notice through the Income Tax e-filing portal. In eligible cases, a taxpayer may request a condonation of delay from the appropriate income tax authority if the return could not be filed within the specified time due to a valid reason.

Application for Condonation of Delay

The CBDT has issued guidelines for taxpayers who were unable to file their ITR on time and desired to claim a refund or carry forward eligible losses. In these cases, a condonation of delay application can be submitted to the competent income tax authority, subject to certain applicable conditions. 

Limitations for Filing the Application

The competent authority may accept a condonation request if the taxpayer gives a genuine and reasonable cause for the delay and furnishes the necessary supporting documents. The acceptance of the application is as per the applicable provisions and the satisfaction of the concerned authority.

Tax and Interest on Late Filing

The taxpayer should pay the applicable tax and interest as per the Income Tax Act if having an outstanding tax liability. As per the situation, interest can be applicable under Sections 234A, 234B, and 234C.

If the taxpayer has previously filed the applicable taxes but does not submit the ITR, then they must verify whether a belated return or an updated return is available for the related assessment year. An ITR-U may be available as per the applicable conditions and regulatory time limits.
